Data protection declaration of the website www.diavisions.de

§ 1 Information about the collection of personal data

  1.  In the following we inform you about the collection of personal data when using our website. Personal data is all data that can be related to you personally, eg your name, address, e-mail addresses and (if applicable) your user behavior.

  2.  Responsible according to Art. 4 Para. 7 EU General Data Protection Regulation (GDPR).

  3. When you contact us by e-mail or via a contact form, the data you provide (your e-mail address, your name and your specific message if applicable) will be stored by us in order to answer your questions. We delete the data arising in this context after the storage is no longer necessary, or restrict the processing if (e.g. tax) legal storage obligations exist.

  4. If we use commissioned service providers for individual functions of our offer or would like to use your data for advertising purposes, we will inform you in detail below about the respective processes. We also state the specified criteria for the storage period.

 

§ 2 Your rights

  1.  You have the following rights towards us with regard to your personal data:
    - right to information,
    - right to rectification or erasure,
    - right to restriction of processing,
    - Right to object to the processing as well
    - Right to data portability.

  2. You also have the right to complain to a data protection supervisory authority about what you consider to be illegal processing of your personal data by us.

  3.  If you have asserted your rights to correction, deletion or restriction of processing listed in paragraph 1 against us, we are obliged to provide all recipients to whom the personal data concerning you have been disclosed the desired Correction or deletion of the data or restriction of processing, unless this proves impossible or involves a disproportionate effort. In any case, you have the right to be informed about these recipients.

  4.  We would like to point out that we do not use any automated decision-making in accordance with Article 22 Paragraphs 1 and 4 DS-GVO.

 

§ 3 Collection of personal data when visiting (= calling up) our website

  1. If you visit the website for information only (= call), ie if you do not provide us with any other information, we only collect the personal data that your browser transmits to our server. If you would like to view our website, we collect the following data that is technically necessary for us to display our website to you and to ensure stability and security (legal basis is Art. 6 Para. 1 S. 1 lit. f DS-GVO ):

    • Date and time of the request
    • Time zone difference to Greenwich Mean Time (GMT)
    • Content of the request (specific page)
    • Access Status/HTTP Status Code
    • amount of data transferred in each case
    • Website from which the request comes
    • Browsers
    • Operating system and its interface
    • Browser software language and version.

  2.  In addition to the aforementioned data, cookies are stored on your computer when you use our website. Cookies are small text files that are stored on your hard drive and assigned to the browser you are using and through which certain information flows to the place that sets the cookie (here from us). Cookies cannot run programs or transmit viruses to your computer. They serve to make the Internet offer more user-friendly and effective overall.

  3. Use of cookies:
    a) This website uses the following types of cookies, the scope and functionality of which are explained below:
    • Transient cookies (see b)
    • Persistent cookies (see c).
    b) Transient cookies are automatically deleted when you close your browser. These include in particular the session cookies. These store a so-called session ID, with which various requests from your browser can be assigned to the joint session. This allows your computer to be recognized when you return to our website. The session cookies are deleted when you log out or close the browser.
    c) Persistent cookies are automatically deleted after a specified period, which can vary depending on the cookie. You can delete the cookies in the security settings of your browser at any time. Persistent cookies are deleted after 30 days at the latest, unless otherwise stated in the following provisions.
    d) You can configure your browser settings according to your wishes and e.g. B. refuse to accept third-party cookies or all cookies. We would like to point out that you may not be able to use all the functions of this website.

 

§ 4 Further functions and offers of our website

  1. In addition to the purely informational use of our website, we offer various services that you can use if you are interested. To do this, you usually have to provide additional personal data that we use to provide the respective service and for which the aforementioned data processing principles apply.

  2.  In some cases, we use external service providers to process your data. These have been carefully selected and commissioned by us, are bound by our instructions and are regularly checked.

  3. Furthermore, we can pass on your personal data to third parties if we offer contracts or similar services together with partners. You will receive more detailed information on this when you provide your personal data. As part of the hosting of our website, we use the company Power-Netz Symgenius GmbH & Co. KG, Am Plan 1, 37581 Bad Gandersheim, Germany, whose servers are also located in the Federal Republic of Germany.

  4. If our service providers or partners are based in a country outside the European Economic Area (EEA), we will inform you about the consequences of this circumstance in the description of the offer.

 

§ 5 Objection or revocation against the processing of your data

  1. If you have given your consent to the processing of your data in individual cases, you can revoke this at any time under Section 1 Paragraph 2 above or in the imprint linked there. Such a revocation affects the admissibility of the processing of your personal data after you have given it to us.

  2. If we base the processing of your personal data on the balancing of interests, you can object to the processing. This is the case if the processing is not necessary in particular to fulfill a contract with you, which is shown by us in the following description of the functions. If you exercise such an objection, we ask that you explain the reasons why we should not process your personal data as we have done. In the event of your justified objection, we will examine the situation and will either discontinue or adjust the data processing or show you our compelling reasons worthy of protection on the basis of which we will continue the processing.

  3. Of course, you can object to the possible processing of your personal data for advertising and data analysis purposes at any time. You can inform us about your objection to advertising using the contact details specified in Section 1 (1).

 

§ 6 Use of Google Analytics

  1. This website uses Google Analytics, a web analytics service provided by Google Inc. ("Google"). Google Analytics uses so-called "cookies", text files that are stored on your computer and enable an analysis of your use of the website. The information generated by the cookies about your use of this website is usually transmitted to a Google server in the USA and stored there. If IP anonymization is activated on this website, your IP address will be shortened beforehand by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be sent to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity and to provide other services related to website activity and internet usage to the website operator.

  2. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.

  3. You can prevent the storage of cookies by setting your browser software accordingly; we would like to point out to you however that in this case you will if applicable not be able to use all functions of this website in full. You can also prevent the data generated by the cookie and related to your use of the website (including your IP address) being sent to Google and the processing of this data by Google by using the browser plug-in available under the following link.   4. This website uses Google Analytics with the extension "_anonymizeIp()". As a result, IP addresses are further processed in abbreviated form, which means that they cannot be linked to individuals. If the data collected about you has a personal reference, this will be excluded immediately and the personal data will be deleted immediately.

  5. We use Google Analytics to analyze and regularly improve the use of our website. We can use the statistics obtained to improve our offer and make it more interesting for you as a user. For the exceptional cases in which personal data is transferred to the USA, Google has submitted to the EU-US Privacy Shield,  https://www.privacyshield.gov/EU-US-Framework.  The legal basis for the use of Google Analytics is Article 6 Paragraph 1 Sentence 1 lit. f GDPR.

  7. This website also uses Google Analytics for a cross-device analysis of visitor flows, which is carried out using a user ID. You can deactivate the cross-device analysis of your usage in your customer account under “My data”, “Personal data”.

  8. Any cookies used in connection with this Section 6 will be deleted after 14 months at the latest.

 

§ 7 Use of social media links

  1. We currently use links to the following social media sites: Facebook, Google+, Twitter, LinkedIn, Youtube. However, these are pure links, no plugins. This means that when you visit our site, no personal data is initially passed on to the providers of the social media sites. You can identify the provider of the social media pages by the marking on the box above their initials or the logo. We give you the option of going directly to the third-party website using the button. Only when you click on the link does the social media site provider receive the information that you have accessed the corresponding website of our online offer. In addition, the data mentioned under § 3 of this declaration will be transmitted. In the case of Facebook, according to the respective provider in Germany, the IP address is anonymized immediately after collection. By visiting the social media pages, your personal data may be transmitted to the respective provider and stored there (in the USA for US providers). Since the respective social media site provider collects data in particular via cookies, we recommend that you delete all cookies via the security settings of your browser before clicking on the link.

  2. We have no influence on the collected data and data processing procedures, nor are we aware of the full extent of the data collection, the purposes of the processing, the storage periods. We also have no information on the deletion of the data collected by the social media site provider.

  3. The social media site provider stores the data collected about you as usage profiles and uses them for advertising, market research and/or needs-based design of its website. Such an evaluation is carried out in particular (also for users who are not logged in) to display needs-based advertising and to inform other users of the social network about your activities on our website. You have the right to object to the creation of these user profiles, whereby you must contact the respective social media site provider to exercise this right. On the social media pages, the respective provider also offers you the opportunity to interact with us on social networks and other users, so that we can improve our offer and make it more interesting for you as a user. The legal basis for the use of our own profiles there is Art. 6 Para. 1 S. 1 lit. f GDPR.

  4. The data is passed on regardless of whether you have an account with the social media site provider and are logged in there. If you are logged in to the social media site provider, your data collected from us will be assigned directly to your existing account with the social media site provider. We recommend that you log out regularly after using a social network, but especially before activating a button or link, as this way you can avoid being assigned to your profile with the social media site provider.

There you will also receive further information on your rights in this regard and setting options to protect your privacy.

§ 8 Integration of YouTube videos

  1. We have integrated YouTube videos into our online offer, which are stored on  http://www.YouTube.com   and can be played directly from our website. These are all integrated in "extended data protection mode", ie no data about you as a user is transmitted to YouTube if you do not play the videos. The data mentioned in paragraph 2 will only be transmitted when you play the videos. We have no influence on this data transmission.

  2. By visiting the website, YouTube receives the information that you have accessed the corresponding subpage of our website. In addition, the data mentioned under § 3 of this declaration will be transmitted. This occurs regardless of whether YouTube provides a user account through which you are logged in or whether there is no user account. If you are logged in to Google, your data will be assigned directly to your account. If you do not wish to be associated with your profile on YouTube, you must log out before activating the button. YouTube stores your data as usage profiles and uses them for advertising, market research and/or needs-based design of its website. Such an evaluation is carried out in particular (even for users who are not logged in) to provide needs-based advertising and to inform other users of the social network about your activities on our website. You have the right to object to the creation of these user profiles, whereby you must contact YouTube to exercise this right.
